Joan Laporta has been charged -now called under investigation- by judge Joaquin Aguirre, the magistrate in charge of investigating the 'Negreira affaire' and Barcelona's payments to the former vice-president of the CTA, according to media such as 'Cadena SER' and 'El Mundo'.
Laporta is charged with bribery, the same offence as former Barca presidents Sandro Rosell and Josep Maria Bertomeu, as well as Enriquez Negreira, his son Javier Enriquez and Barcelona themselves.
According to 'El Debate', Laporta has already received the notification from the Mossos d'Esquadra on Wednesday, personally.
In the judge's statement, quoted by 'Cadena SER', the magistrate assures that the statute of limitations should be counted in a different way to the one being used, and that due to this new way, Laporta will be investigated for the acts carried out between 2008 and 2010.
The judge argues that as it is considered a crime of continuous duration, the law should not be taken from the day on which the case was initiated, but from the day on which it was committed for the last time, i.e. 18th July 2018. Therefore, instead of counting from 2013, the investigation of the offence starts from 2008.
This would include payments made from July 2008 to 2010, a period for which the Laporta-led board that preceded Sandro Rosell at the head of the club would be responsible.
In the case of Negreira and his son, the order specifies that the imputable acts would go back to June 2003, given that the penalty to which they are exposed, as they are considered public officials for criminal purposes, exceeds 10 years of disqualification.
Although so far no evidence has been found that the payments to Enriquez Negreira were intended to favour Barca through refereeing, the judge believes that his actions "had to benefit FC Barcelona to the detriment of the rest of the clubs in La Liga or their rivals in the Copa del Rey".
